In the 2026 New York State legislative session, our union’s advocacy has led to the passing of two bills in the Assembly & Senate.
If signed by Governor Kathy Hochul, these bills will create more slots, allow educators to safely care for more children, improve access to childcare for working families, and educators could continue providing care without worry about constant renewals.
The Child Care Capacity Expansion Bill (A.10025/S.9728) passed in both the Assembly & Senate, and is sponsored by Assemblymember Sarah Clark and Senator Samra Brouk. This bill lowers the age of an “infant” to 18 months, allowing one caregiver for every two children under 18 months of age in group family day cares and family day cares. The passage of this bill would bring equity to requirements for home-based childcare educators and childcare centers.

License renewals have also been extended to six years. Initial and following registrations will be valid for up to six years as long as educators stay in compliance with OCFS regulation.

What’s next?
We are working to make sure this legislation is signed by Governor Kathy Hochul. The Child Care Expansion Bill is headed to the governor’s desk, if she signs it the legislation will take effect in 180 days.
The extension of six year renewals will take effect June 5, 2027.
